1.0 Agreement

This Service Agreement will be between (WebsitesForValue and its subsidiaries), known as "we", "us" and "our", and the (User, Client, or Customer), known as “you”, “your” which refers to any party who signs-up for, or purchases any services from WebsitesForValue.com. This Agreement explains our obligations to you, and your obligations to us. By purchasing our products and services you agree to establish an account with us for such services, and to the terms herewith in. We reserve the right to change or modify all or any part of this agreement at any time, effective immediately upon posting, continued use of the service constitutes your binding acceptance of any amended terms and conditions. If at any time you do not agree with the terms, you should immediately cease all use of the service(s) by sending an email request to webdesign@websitesforvalue.com .

2.0 Value Websites

Value websites are offered as a package which includes up to (5) five web pages, (1) one email account, hosting, Website Manager (editing software), and Tech Support. The term and agreement is for 1 year. When using Website Manager at NO TIME SHALL ADULT CONTENT OR PHOTOS BE UPLOADED TO YOUR WEBSITE. Immediate action will be taken to close the website.

2.1 Web Design: These websites are pre-designed templates. Our expert web developers will create your website for you once all of your information has been submitted. You may change the main header picture, company logo, and navigation links on the template without a charge. Changes made to the layout design and web page colors will be an additional cost.

2.2 Web Hosting: The customer understands that WebsitesForValue MUST provide the hosting service to receive the Value Website package. The $29.95 is for the monthly management, Website Manager, hosting, and Tech Support of the website not the purchase of it. The customer does not own the website until they purchase it. During the first year of service the customer may purchase the website at a discounted rate of $499 ($599 value). After one year of service the Client may purchase the website for $199.

2.3 Domain Name: The Client will be responsible for the cost of their domain name after the first year. At any time the domain name may be transferred with no fees by WebsitesForValue.com.

2.4 Authorization: Client agrees to pay, and authorize WebsitesForValue.com to automatically debit $29.95 a month plus any extra products or services added to the Value website, by way of Check ACH debit or Credit Card debit for as long as they have the service.

2.5 The WebsitesForValue Name: WebsitesForValue will place our name and link at the bottom of every web page we develop; it should not be removed or deleted . Removing our name and link may result to canceling the service.

2.6 Cancellations: The Client may discontinue service any time after the first year by written request to webdesign@websitesforvalue.com , with the understanding the website cannot be used without the hosting and management or without purchasing the website from WebsitesForValue.com. At any time the Client has the right to purchase the website and use another hosting provider (to purchase your website see section 2.2).

Early Cancellation - If the Client decides to cancel their Value website before the development stage, there will be no charge. If the Client cancels after the development stage there will be a $30 development fee. No refund cancellations may take place after the website goes live and upload to the Internet.

3.0 General Support Services

WebsitesForValue.com offers email and phone support services. Clients in good standing (paid services that are current) may submit an unlimited amount of support related questions or concerns by email through our on-line customer support, available on the WebsitesForValue website. Some Tech Support request may be billable.

3.1 Web Design Tech Support: Questions related to your website or web design issues will be answered by our expert Web Designers Monday thru Friday from 9am to 5pm Central Standard Time.

3.2 Service Support Ticket : Clients may submit a Service Support Ticket when their website is down or having problems. Some issues may be billable at a rate of $89 per hour. Tech Support will inform the Client before services are rendered if there request is billable. All billable Support Tickets are prepaid.

3.3 Products and Solutions Tech Support: Questions related to Domain Names, Email Accounts, Fax to Email, etc., will be answered by our Solutions Tech Support 24 hours a day, 7 days a week.

3.4 Problem Resolution: WebsitesForValue may take up to 48 hours for problem resolution. If additional time is needed the Client will be advised.

4.0 Limitation on Liability

WebsitesForValue is not responsible for any breach of security or for any actions of any third parties which receive information by hacking, breaking into, or crashing our servers.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT WEBSITES FOR VALUE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WEBSITES FOR VALUE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

5.0 Proprietary Rights

5.1 Copyright: All content created by WebsitesForValue, its partners, or its suppliers and included on our website, such as text, graphics, logos, button icons, images, audio clips, and software, is the property of WebsitesForValue (or its partners or suppliers) and protected by U.S. and international copyright laws.

5.2 Trademarks: WebsitesForValue.com is a trademark of A.D. Mask Group. Trademarks may not be used in connection with any product or service that is not A.D. Mask Group's, in any manner that is likely to cause confusion among Customers, Clients, or Users or in any manner that disparages or discredits WebsitesForValue.com or A.D. Mask Group.
